DEFINITION OF TERMS

I. Artist --------------------- the individual producing the Commission.
II. Client -------------------- the individual purchasing the Commission.
III. Patron ------------------- the form of service (Ko-fi) where the Client can donate and show support to the Artist and produce a Commission as a token based on the pricelist.
IV. Project ------------------ the form of service provided by the Artist to the Client as per the Commission Agreement.
V. Product ------------------ the output of the art through items/merchandises.
VI. Buyer ------------------- the individual purchasing the Product.
VII. Order Confirmation ------------------ the form of invoice sent from the Artist to the Buyer for which lists and costs are provided.

COMMISSION AGREEMENT

  1. The copyright of the Artist's Patron work is for personal use only. Whereas for Project purpose have different commercial rates and process terms in a separate contract form.

  2. The Artist has the right to refuse any Commission request if they feel uncomfortable and/or something that they cannot fulfill. However, the Artist will likely explain reasoning for decline out of courtesy.

  3. The Artist reserves the right to cancel on a Commission for any unexpected reason, i.e. due to conflict schedule, work, health, personal issues, poor communication within the Client, inappropriate behavior, or violated of these Terms of Service.

  4. The Artist will not work in any NFT (Non-Fungible Token) nor cryptocurrency related.

  5. The Artist may use the final pieces(s) for portfolio or promotional purposes unless permitted by the Client. If the Client wishes to define as confidential, then until such time the Artist will publicly display the artwork until granted.

  6. The prioritization of each commission will be worked on by accordingly. The Artist may take at least 2-6 weeks to finish a piece once started. Time may vary depending on the complexity and workload. A rush fee may be applied if the Commission is considered time-sensitive.

  7. The Artist will decline a Commission if the Client is strictly non-flexible on deadlines and prefers shorter due date.

  8. The Artist will have to send out a Google form (invoice) for Project method.

  9. The Client may NOT ask intently for discounts. However, the Artist may offer only to specific occasions and/or unless stated otherwise.

  10. The Client must detail out the content of their Commission to their best ability.

PAYMENT

  1. Payments are in Philippine Peso (PHP) or U.S. Dollar (USD).

  2. Accepting full payments up-front via Ko-fi or GCash for Patron work only. Whereas for Project option shall be paid via direct PayPal, GCash, or bank account transfer.

  3. For Project method, the Artist requires payment options to be made: A) Full payment up-front before starting the piece or after an approval of the Draft; or B) 50% up-front after the Draft approval and 50% at the completion of the Commission.

  4. Strictly NO CANCELLATION of Commission once already paid and/or the Artist have already started with your piece. However, if a cancellation still insists, a 50% of the total amount will only be refunded.

  5. A maximum of two (2) minor revisions is allowed only. Additional fee will apply for the following revisions. (This is exclusively for Projects only and not for Patron works).

  6. Extra character requests and backgrounds will also require additional costs. Informing this to the Artist beforehand is highly encouraged.

PROCESS AND USE

  1. An invoice will be sent out to the Client to fill out after the Artist and Client have processed their final agreement.

  2. The Artist will start working once the payment process is successful.

  3. A high resolution (.png) file of the finished piece will be sent through email. And for Patron works, the Artist will also likely post on social media and Ko-fi feed.

  4. NO W.I.P.s (Work In Progress) for Patron works.

  5. The Client's preferred preference, e.g. palette, outfit, or sample pictures of the character/referrals of any sort must attach along via email only.

  6. The Client shall NOT claim the artwork as their own nor distribute, reproduce, or otherwise profit from the Artist.

  7. The Client may NOT incorporate the Commission in another Artist’s commission, amend, nor conduct a modification.

  8. The Client may NOT use the artwork for contests.

The Artist expects the Client to have fully read and understood that is stated in the Terms of Service and that both sides agreed all that constitutes.The Artist reserves the right, at their discretion, to change, modify, add to, or remove portions of the Terms of Service at any time. An announcement post may be notified of any changes or a revised version of the Terms incorporating the changes to the website.

MERCHANDISE, ORDER AND PAYMENT

  1. Merchandises are only available to PH Buyers for now. Other customized Products will be accessible through the selected print-on-demand site/s of the Artist.

  2. Payments are processed via GCash or bank transfer only.

  3. Products are subject to availability — but during on a rare situation, if a merch is found to be lacking/out-of-stock at the time of pre-order or pick-up, the Artist will inform the Buyer and may ask to choose either to cancel order or to stand-by for new arrivals.

  4. The production and packing process will take around 2-3 weeks after the deadline of orders. Though this may still vary depending on its production. The Artist will check thoroughly of the items and ensures everything are accurate.

  5. The Artist endeavors to display the actual colours of the Products as accurately as they can. However, the Artist cannot guarantee that the colour of a Product as delivered will imitate how it appeared to the Buyer's on-screen. This may depend upon your computer display monitor/mobile screens, and how you perceive colour. There are instances that the outcome of the print may also differ from the production process itself.

  6. Orders are shipped out during working days and rush shipping is not allowed. Delays may also be necessary due to uncertain circumstances, i.e. inclement weather, out of packaging, technical issues, or an emergency.

  7. Orders placed over busy/holiday periods will take longer than usual due to the increased of volume orders.

  8. The Artist reserves the right to decline orders for any reason.

  9. The Artist will not be held responsible for inaccurate and/or missing information submitted by the Buyer. It is recommended to have an updated details before placing an order.

  10. There is only one delivery charge per order, and packing fee is included mostly with the Product price unless stated otherwise.

REFUND AND CANCELLATION POLICY

  1. The Artist is not liable for any loss nor damage merchandise caused by the courier unless added with an insurance fee by the Artist. Rest assured that all items will be packed properly and complete before shipping out.

  2. The Artist may also inform and/or post if there are any minor faulty damages in any of the Products upon receiving.

  3. UNEDITED UNBOXING VIDEO IS RECOMMENDED!

  4. There are some exceptions that may not be able to cover for a refund. This will be included on the Product's list if stated.

  5. The Artist will not be able to offer return nor exchange items.

  6. Strictly NO CANCELLATION of order if the Buyer has already submitted the order form and/or paid for the Products. However, if a cancellation still insists, a 50% of the total amount will only be refunded.

  7. The Artist reserves the right to cancel on an order for any unexpected reason (even if you have received your Order Confirmation email) i.e. availability of a Product, price, or description. In the unlikely event happens, you will receive a full refund of any charges already paid.

  8. Joy Reservers and Bogus Buyers will be automatically blacklisted and posted on the Artist's social feeds.
